MLMIA: House Votes to Continue Ban
on Taxes of Internet Services

On May 11, the U.S. House of Representatives voted to continue the ban on Internet-specific taxes (H.R. 3709). If the House bill is ultimately enacted, the moratorium on those taxes would continue for another five years (until October 21, 2006). However, it is unclear whether the Senate will vote on the legislation (S. 2255) and unlikely the president will sign it.
Specifically, the House bill extends the moratorium on the taxation of data transmission, e-mail and other Internet services. It also would eliminate a grandfather clause in the original legislation banning Internet taxes, which permitted the states to keep any existing taxes on Internet access. The House bill would not affect sales taxes on online purchases.
The House is also considering two other Internet-related tax bills. One bill (H.R. 1291) would prevent the Federal Communications Commission from imposing new access charges on monthly Internet service bills to pay for a federal program that subsidizes rural telephone service. The other bill (H.R. 3916) would repeal an existing three percent federal excise tax on telephone service that was first levied in 1898.
